Terms of Service

These Terms of Service govern your access to and use of the SkillPath platform and all associated services. By registering or using SkillPath, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

 

1. The Platform

SkillPath is an AI-powered career intelligence platform that matches individuals to careers, internships, and employment opportunities based on skill profiles, AI scoring, and growth trajectory. The Platform is operated by StartupLab Business Center, General Trias, Cavite, Philippines.

 

2. Eligibility

•       Talent Users (students, interns, professionals) must be at least 15 years of age.

•       Employer Account Holders must be at least 18 years of age.

•       You must have the legal capacity to enter into a binding agreement.

•       By registering, you confirm that all information provided is accurate and complete.

 

3. User Accounts

3.1 Registration

You must create an account to access SkillPath's core features. You are responsible for providing accurate information and keeping your account details current.

3.2 Account Security

You are solely responsible for all activity under your account. You must not share your login credentials with any other party. Notify SkillPath immediately at hello@startuplab.ph if you suspect unauthorized access.

3.3 Account Types

•       Talent Account (Free / Premium): for students and professionals seeking career matching and internship opportunities.

•       Employer Account (Subscription): for companies and organizations posting opportunities and accessing the talent pool.

•       Partner Account: for universities and training institutions collaborating with SkillPath.

 

4. License to Use the Platform

SkillPath grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform strictly in accordance with these Terms. This license does not include the right to resell, sublicense, or commercially exploit any Platform content or services.

 

5. AI Career Matching — Important Disclaimer

SkillPath's AI Career Engine generates career path predictions and Match Scores based on structured skill mapping and algorithmic logic. These outputs are guidance tools only and do not constitute professional career advice, a guarantee of employment, or an assessment of legal suitability for any role. Hiring decisions are made solely by Employers and are outside SkillPath's control.

 

6. Subscriptions and Payments

6.1 Employer Subscriptions

Employer access to the talent pool and AI matching tools requires a paid subscription. Pricing tiers and billing cycles are available on the Platform. SkillPath reserves the right to update pricing with 30 days' written notice.

6.2 Success Fees

A success fee may apply upon confirmed internship placement or intern-to-hire conversion. Applicable fees are communicated prior to engagement and set out in the relevant service agreement.

6.3 Premium Talent Accounts

Basic Talent Account features are free. Upgraded features (advanced career prediction, priority matching, blockchain resume publishing) are available under a paid Premium Account.

6.4 Refunds

Subscription fees are generally non-refundable except where required by Philippine law or as stated in a separate service agreement. Refund requests must be submitted in writing to hello@startuplab.ph.

 

7. Intellectual Property

7.1 SkillPath's IP

All rights in the Platform, AI Career Engine, matching logic, design, software, and content belong to SkillPath and its licensors. Nothing in these Terms transfers any ownership of SkillPath's intellectual property to Users.

7.2 Your Content

You retain ownership of the User Content you submit (Skill Profile, resume, etc.). By submitting content, you grant SkillPath a worldwide, non-exclusive, royalty-free license to use, process, and display that content solely for delivering and improving Platform services.

 

8. Additional Terms for Employers

•       Post only genuine, lawful, and accurately described employment or internship opportunities.

•       Comply with all applicable Philippine labor laws, equal opportunity regulations, and employment eligibility requirements.

•       Not request that candidates pay fees, deposits, or make purchases as a condition of employment.

•       Post only one position per job listing. Multiple positions require separate postings.

•       Not repost the same position within 14 days of the original posting date.

•       Use candidate data solely to evaluate suitability for employment, and delete it once no longer needed.

•       Not share candidate data with third parties without explicit consent.

•       Notify SkillPath immediately upon discovery of unauthorized account access.

 

9. Additional Terms for Talent Users

•       Provide accurate and truthful information in your Skill Profile and resume.

•       Not impersonate another person or create profiles on behalf of another individual.

•       Understand that your Skill Profile will be visible to Employers using the Platform.

•       Accept that AI Match Scores are algorithmic guidance, not professional career advice.

•       Not apply for opportunities on behalf of another party.

 

10. Termination

10.1 By SkillPath

SkillPath may suspend or terminate your access immediately if you breach these Terms, engage in fraudulent activity, or if submitted information cannot be verified. Inactive accounts may be deleted after a significant period with prior notice where practicable.

10.2 By the User

You may cancel your account at any time by contacting hello@startuplab.ph. Upon cancellation, your content will be marked for deletion from active Platform databases. Sections 5, 7, 11, 12, 13, and 14 survive termination.

 

11. Limitation of Liability

To the maximum extent permitted by Philippine law, SkillPath's total liability to any User shall not exceed the total fees paid by that User in the three months preceding the claim. SkillPath is not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost data, or business interruption.

 

12. Indemnification

You agree to indemnify and hold harmless SkillPath, StartupLab Business Center, and their officers, directors, and employees from and against any claims, damages, or expenses arising from your use of the Platform, your User Content, or your violation of these Terms.

 

13. Governing Law

These Terms are governed by the laws of the Republic of the Philippines. Any disputes shall be resolved before the appropriate courts in the Philippines. The parties shall first attempt to resolve disputes amicably within 30 days before initiating formal proceedings.

 

14. Updates to These Terms

SkillPath may update these Terms with 14 days' notice via email or Platform announcement. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
